On Ashar 30, the High Court of Patan has upheld the decision of the District Court to convict three members of the Constituent Assembly for misusing red passports and tampering with government documents.

Justices Khadka Bahadur KC and Gopal Prasad Bastola have upheld the District Court’s decision to convict Gayatri Sah, Vishwanath Prasad Yadav, and Shivpujan Rai, among others, of the charges.

Sah was a member of the Nepali Janata Dal, Yadav was a member of the then Madhesi Janadhikar Forum, and Rai was a member of the then CPN-Maoist.

The District Court of Kathmandu had convicted them on Jestha 21, 2071, and sentenced them to five months in prison and a fine of Rs 500.

Additional Convictions

In addition to the three Constituent Assembly members, five others have been convicted of playing the role of middlemen in the red passport case.

The High Court of Patan has sentenced Dil Bahadur Gharti, Gopal Baniya, Prithvi Chantyal, Manoj Kumar Karki, Devendra Paudel, and Santosh Raj Upreti to one year in prison and a fine of Rs 554,000 for tampering with government documents.

They had previously been charged with corruption.

Related Cases

The Special Court had convicted Constituent Assembly members Shivpujan Rai, Vishwanath Prasad Yadav, and Gayatri Sah of the charges and sentenced them to three months in prison and a fine of Rs 15,000.

The case is currently pending in the Supreme Court.

The Supreme Court had stayed the case after the lawyers of the former lawmakers requested that the hearing not be held until the case of tampering with government documents is resolved.
