A Kathmandu court has found Everest Hospital and Dr. Jyotsna Sharma Tewari guilty of negligence in the treatment of a patient, Manita Sharma, who died during childbirth. The court has ordered the hospital and the doctor to pay a total compensation of Rs 39 lakh to the victim’s family.
The court’s verdict stated that the hospital and the doctor were responsible for the patient’s death due to their negligence in providing proper treatment. The patient, Manita Sharma, was suffering from severe pre-eclampsia and was admitted to the hospital on Ashar 25, 2083. Despite her critical condition, the hospital and the doctor failed to provide her with the necessary treatment, including the administration of magnesium sulfate before surgery.
The court’s verdict was based on the testimony of various medical experts, including Dr. Sunita Joshi Rawal, a gynecologist at Tribhuvan University Teaching Hospital, and Dr. Puran Gurung, a specialist at Patan Academy of Health Sciences. The experts testified that the administration of magnesium sulfate before surgery was a standard protocol for patients with severe pre-eclampsia.
The court also cited the World Health Organization’s (WHO) guidelines for the treatment of pre-eclampsia and eclampsia, which emphasize the importance of administering magnesium sulfate to prevent complications.
The hospital and the doctor had argued that they had not been negligent in their treatment of the patient, but the court rejected their claims. The court stated that the hospital and the doctor had failed to provide the patient with the necessary care and treatment, and that their negligence had resulted in her death.
The court’s verdict has been welcomed by the victim’s family, who had been seeking justice for their loved one’s death. The case highlights the need for hospitals and medical professionals to follow standard protocols and guidelines to ensure the safety and well-being of their patients.
