The Nepal Bar Association (NBA) has expressed concerns about the independence of the judiciary in Nepal. In a recent interview, NBA President and senior advocate Vijay Prasad Mishra stated that the judiciary’s independence is being compromised due to various factors.
Mishra mentioned that the recent appointment of a new Chief Justice has raised concerns about the judiciary’s independence. He stated that the Chief Justice’s decision to form a constitutional bench without following the seniority principle has created controversy.
The NBA President also expressed concerns about the increasing trend of ‘populism’ in the judiciary, where judges are more focused on gaining public attention rather than delivering justice. He emphasized that the judiciary should be a place for delivering justice, not for seeking popularity.
Mishra also highlighted the issue of pending cases in the Supreme Court, which has over 27,000 cases pending. He stated that the judiciary should focus on delivering justice rather than seeking publicity.
The NBA President also expressed concerns about the recent trend of live broadcasting of court proceedings, which he believes can compromise the independence of the judiciary. He emphasized that the judiciary should be a place for delivering justice, not for seeking publicity.
Mishra also mentioned that the NBA has been working to promote the independence of the judiciary and has been advocating for reforms to ensure that the judiciary remains independent and impartial.
