Ncell, a private telecommunications service provider, has submitted a petition to the Prime Minister’s Office, claiming that certain conditions set by the government for license renewal are unfair and illegal.
The company has stated that these conditions will have a significant impact on its business, investment, and service operations.
The Nepal Telecommunications Authority (NTA) renewed Ncell’s mobile service license for five years on 16th Bhadra, 2081, but the company has expressed objections to two main conditions.
Firstly, Ncell claims that the condition of paying 10% annual interest on the remaining renewal fee is against the law.
Secondly, the condition that the company’s share structure cannot be changed after renewal is also deemed illegal by Ncell.
According to Ncell, these conditions are against the constitutional rights of property and business freedom.
The company has also stated that similar conditions were not applied to Nepal Telecom during its license renewal, and this is a discriminatory practice.
Ncell has requested the Prime Minister’s Office to review these conditions, stating that they are unfair and illegal.
The company has also proposed a new plan, which includes transforming into a fully Nepali company by increasing Nepali ownership to more than 50%.
Ncell has also expressed its commitment to investing in 5G and digital technology if a fair and lawful solution is found.
The company has a significant presence in Nepal, with over 1.4 million customers and providing direct and indirect employment to over 100,000 people.
Ncell has warned that if the dispute is not resolved, it may lead to a crisis in the telecommunications sector, affecting the country’s investment-friendly environment.
The company has requested a lawful and business-friendly solution to the problem.
