Court Orders Land Registration for Muktakamaiya and Landless Sukumbasi

A high court in Tulsipur has issued an order regarding the registration and management of land received by Muktakamaiya and landless Sukumbasi.

The joint bench of judges Madan Pokharel and Shakuntala Ghimire issued a mandamus order in the name of the Land Administration Office, Banka, and a directive order in the name of the concerned government agencies on Thursday.

Background

According to the court’s information officer, Bal Bahadur Vishwakarma, the order was issued in response to a public interest writ petition filed by Agniya Tharu and others on Baisakh 28, 2082.

The petitioners, including Sitaran Tharu, Agniya Tharu, and Sita Tharu, among others, had sought the court’s intervention to resolve the issue of land registration and management.

Court’s Decision

The court has ordered the Land Administration Office to register the land in the name of Muktakamaiya or Sukumbasi, and to complete the necessary formalities for the transfer of ownership.

The court has also directed the government to take necessary steps to provide land to the landless Sukumbasi, who have not been able to obtain land despite receiving certificates from various commissions.

Conditions

The government had imposed a condition that the land received by Muktakamaiya could not be sold, transferred, or donated for 10 years.

However, the petitioners argued that despite receiving the land in 2058, they had not been able to complete the necessary formalities, including registration and transfer of ownership, even after two decades.
